After the complaint is filed and served or delivered (both parties get copies) the defendant or defendants are given from seven to sixty days to respond to the complaint, The time frame depends on your location. The litigation support consultant assists the lawyer in the preparation of the complaint or the reply. After the answer is filed and delivered, each party, exchange a series of information and documents. Then the lawyers then put together motions (this is request for court action). After this phase, the lawyers of both sides can either recommend to their clients to go with mediation or an out of court settlement. If neither parties accept the other’s offer the case will continue to trial.

Most support members are experts or specialist in their specific professional field. They are experienced professionals that offer their services to study evidences and report their findings to the court. They call them also as expert witnesses.

A litigation support consultant may possibly be a court reporter or a lawyer who is employed by a litigation support organization. These individuals assist attorneys in the preparation and presentation of their cases. They are involved with meeting with witnesses, and checking and going over documents. They’re also responsible in researching evidence presented by witnesses. A litigation support coordinator may also be a private individual who works from a home office as a independent consultant.
